Hugues Mike, 24, is due in court today following a crash involving a Vauxhall Vectra and BMW 1 Series near to Junction 4 of the motorway, at around 12.50am on Saturday, 8 January.
A man, aged in his 20s, who was a passenger in the Vectra died at the scene after the car crashed into the barriers.
His next of kin have been informed.
Police say formal identification will be arranged in due course.
Three other men who had been travelling in the Vectra were taken to hospital. One of these men, who was another passenger, remains in a critical condition.
The 24-year-old driver of the Vectra was arrested before being discharged from hospital along with the third passenger.
Mike was also charged with causing serious injury by dangerous driving, causing death when driving while disqualified, causing serious injury when driving while disqualified, driving without insurance and driving while disqualified.
The driver of the BMW, a 22-year-old woman, was also arrested on suspicion of causing death by dangerous driving and released under investigation.
Police are continuing to appeal for witnesses or anyone with dash cam footage.
